Favorable Ruling for Clients in Estate Administration Dispute

Adams Leclair attorneys, Paul Leclair and Jeremy Sher, obtained a favorable ruling from Monroe County Surrogate’s Court regarding ownership of more than $300,000 in contested funds the executrix held jointly with the decedent in area banks. Granting our clients’ motion, the Court held the accounts were jointly held for the convenience of the decedent during her lifetime, and were not intended to provide the executrix a right of survivorship in those funds.  The funds were estate assets to be shared evenly among the decedent’s three children, and did not belong exclusively to the executrix of the estate.
